I applied for a job a michaels. WOOhoo! They had a help wanted sign. And while in there yesterday, I just felt so at ease and comfortable. Like art was where I was meant to be -
So, the question is why do I hate it so much most the time? Well, After being advised to talk to JAG. I decided that would be the best thing for me. Since they're in the same building as me ANYWAYS. They said, that since it comes down to he said she said, there is not enough for an actual case on either party. Since I had permission to take the pictures, that gives me rights to the pictures. And since I was doing it for free - that but yet copyrighted the work. It cancels out a portion of copyright laws which state the person can not use the work for further sale. They told me legally, I can keep the pictures on my website because my rights of entitlement.
They said that the mother (whom which will probably read this - since she read the last one). ....Since this was being done for no money- does not require a copy of any pictures unless I am being paid for my work. Which in conclusion would satisfy the laws of copyrights.
They gave me as much 'personal' advice as they did legal advice. They told me in the respective matter of 'child molesters/chester molesters' - if the C.M wanted pictures of a kid that bad they could walk down the street and take pictures of a kid. That in my pictures, -which I showed them. No rights of the child were being violated. They gave me the example of paparizzi (sp)*. That paparizzi walks down the streets of Hollywood taking millions of pictures of celebrities; but not one case has been won - based on the fact the paparizzi member turned around and made hundreds of dollars on the picture.
I was advised that inorder to mend relationships - since the mother is my boyfriends best friends wife (did you follow that?) I should consider just getting prints (paying for them out of pocket) and giving them to the mother. UNDER AGREEMENT she pays me for the out of pocket money. SINCE this was a AGREED FREE job. Although, my orginal idea of doing something a little extra (out of pocket) I'm still considering doing.. out of the kindness of my heart.
I've been told that she is looking into talking to a Lawyer. Personally, if we go to court over it. The JAG officer told me it would be dropped with no substanical evidence. So, with that being said. I really don't care for all this. It's the last time you see me doing a personal favor with out a signed contract and release forum.
Damn, Cat I should have listened to you. I'm terribly sorry. I never realized how out of hand- people can make photography.
Bre I'm so excited!!! I'm going to autocross tomorrow. I've got another lens to take with me.. And I've got some serious ideas. Reading through the manaul for the D70, has not only sharpened up my understanding of photography but has also given me many ideas of exactly what this camera is capable of doing. Oh! How I can't wait!!!
I'll be sure and get some posted up here shortly. Plus, I'm going to find which picture I like the most from Cypress Gardens and enter one in the flowers contest that starts tomorrow. However, finding one.. That's going to be my problem. I don't just have one favorite...
I think that's one of the flaws with digital photography, it allows me to shoot almost 800 pics in one photoshoot.... Which winds up having maybe 20 that I actually adore.
